These Terms of Purchase (“Terms”) apply to all orders and purchases of gym clothes, workout apparel, and other products (collectively, “Products”) made through the Gymshark Official Store website (gynnsheark.com, “Site”). By placing an order on the Site, you (“Customer”) agree to be bound by these Terms, as well as our Terms of Use and Privacy Policy (available on the Site). Please read these Terms carefully before completing your purchase.

1. Order Eligibility & Placement

1.1 Eligibility

To place an order, you must:
  • Be at least 18 years old (or the age of majority in your jurisdiction).
  • Have the legal capacity to enter into a binding contract.
  • Provide accurate, current, and complete information during checkout (e.g., full name, shipping address, payment details).
You represent and warrant that all information you submit is truthful and that you are authorized to use the payment method provided.

1.2 Order Submission & Acceptance

  • When you submit an order through the Site, you are making a formal offer to purchase the selected Products at the listed price (in USD).
  • We reserve the right to accept or reject your order for any reason, including (but not limited to):
    • Product unavailability (e.g., stock shortages).
    • Errors in pricing, product descriptions, or order details.
    • Suspected fraudulent activity (e.g., stolen payment methods, fake shipping addresses).
  • An order is only confirmed (and a binding contract formed) once we send you a written order confirmation email (to the address you provided) and process your payment. If your order is rejected, we will notify you via email and issue a full refund for any payments already processed.

  • All Product prices are displayed in USD and do not include applicable taxes (unless explicitly stated). Taxes will be calculated and added to your order total at checkout based on your shipping address.
  • Prices are subject to change without notice. We are not obligated to honor pricing errors on the Site—even if an order is submitted before the error is corrected. If a pricing error is identified after you place an order (but before shipping), we will notify you immediately to confirm whether you wish to proceed with the corrected price or cancel the order.

3. Shipping & Delivery

3.1 Shipping Options & Timelines

  • Standard Shipping (Free for All Orders): All orders qualify for free standard shipping (no minimum spend required). Orders are processed and shipped within 1–3 days of payment confirmation, with an estimated delivery time of 6–12 days.
  • Expedited Shipping: An expedited shipping option is available at checkout (additional fees apply, as displayed). Expedited orders are prioritized for processing (typically shipped within 1 day) and have a faster delivery window (details provided at checkout based on your location).

3.2 Delivery Responsibilities

  • We will ship your order to the shipping address you provide at checkout. It is your responsibility to ensure the address is correct and deliverable (e.g., includes apartment numbers, avoids missing street names). We are not liable for delays or non-delivery caused by incorrect address information.
  • Delivery times are estimates only and may be delayed due to factors beyond our control (e.g., shipping carrier delays, weather, logistics disruptions). We will notify you of significant delays if we become aware of them.
  • Risk of loss or damage to Products passes to you once the shipping carrier confirms delivery to your address. If you believe a Product was lost or damaged in transit, please contact our customer service team within 3 days of the estimated delivery date.

4. Returns & Refunds

4.1 Return Eligibility

You may return most unused, unworn, and undamaged Products for a full refund (excluding expedited shipping fees, if applicable) within 60 days of the delivery date. To be eligible for a return:
  • Products must be in their original packaging, with all tags, labels, and accessories intact.
  • Products must not show signs of wear, washing, or alteration (e.g., stretched fabric, removed tags).
Certain items (e.g., final-sale Products, personalized items) may be non-returnable—this will be clearly marked on the Product page.

4.2 Return Process

  1. To initiate a return, contact our customer service team at service@gynnsheark.com with your order number, the name of the Product(s) you wish to return, and the reason for the return.
  2. We will respond with a unique Return Authorization (RA) number and detailed instructions (including our return address). Write the RA number on the outside of your return package—this helps us process your request faster.
  3. Ship the Product(s) back to us. You are responsible for covering return shipping costs, unless the return is due to a Product defect, incorrect item, or our error (in which case we will reimburse your return shipping fees after verifying the issue).

4.3 Refund Processing

  • Once we receive and inspect your returned Products (to confirm they meet eligibility requirements), we will process your refund within 5–10 days.
  • Refunds are issued to the original payment method used for the purchase (e.g., credit card, debit card).
  • Your financial institution may take an additional 3–7 business days to reflect the refund in your account—this timeline varies by bank and is outside our control.
  • Expedited shipping fees are non-refundable unless the return is due to our error (e.g., wrong item shipped).

5. Product Availability & Changes

  • Product availability is updated regularly on the Site, but we cannot guarantee that all listed Products will be in stock when you place an order. If a Product becomes unavailable after your order is confirmed, we will notify you via email and offer a full refund or the option to substitute with a similar Product (if available).
  • We reserve the right to modify Product details (e.g., fabric, design, sizing) without notice. If a Product you ordered is modified significantly before shipping, we will notify you to confirm whether you wish to proceed with the modified Product or cancel the order.

6. Limitation of Liability

To the maximum extent permitted by law, Gymshark shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your purchase (including, but not limited to, damages for delayed delivery, Product dissatisfaction, or lost profits). Our total liability to you for any direct damages shall not exceed the total amount you paid for the Product(s) giving rise to the claim.

We may update these Terms of Purchase from time to time. When we do, we will post the revised Terms on the Site. Your continued use of the Site to make purchases after the revised Terms are posted constitutes your acceptance of the changes. We encourage you to review these Terms periodically.
